Medical Malpractice

Injuries caused by a provider's departure from the standard of care.

Overview

A bad outcome is not malpractice. The claim requires proof that a provider departed from the accepted standard of care and that the departure — not the underlying illness — caused the harm. That second element is where most cases are actually contested.

These files are expert-driven from the first week. Most states also require a certificate of merit from a qualified physician before suit can be filed, which means the medical review has to be complete long before any deadline comes into view.

Medical Malpractice questions

How do I know whether it was malpractice or bad luck?

You generally cannot know without a records review by a physician in the same specialty. That review is the first step in every case we take.

Why do these cases take so long?

Records collection, expert review, and the pre-suit requirements many states impose add months before a complaint is even filed.

Does a signed consent form end the claim?

No. Consent covers the known risks of a properly performed procedure. It does not consent to a departure from the standard of care.
